Terms of sale

Version tos-2026-10 · in force from 2 October 2026

In shortYou give us one photo and a few answers. We draw a cartoon character of that person and show it to you. Nothing is charged until you say yes to the drawing. You can cancel for a full refund any time before filming starts. The finished film is yours to keep and share with family and friends.

1. Who we are

FairyTakes makes the films and is the seller (“we”, “us”). You can reach us at fairy@fairytakes.co. These terms are the contract between you and us when you order a film.

2. What you are buying

A personalised animated film, made by software from a photo you provide, starring a cartoon character drawn to resemble the person in the photo. Each order includes the film in the length and quality you chose, a poster, and the credits. Everything is delivered digitally. We do not ship anything physical.

The films are made with artificial intelligence. The character is a stylised drawing, not a photograph, and a generated film can contain small imperfections. Section 8 explains what we do about them.

3. Your account

You must be at least 18 years old to order. Children cannot hold accounts. You sign in with a link sent to your email address, so keep that mailbox secure, and tell us if you think someone else has used your account.

4. Photos and permission

When you upload a photo you confirm, by ticking a box at checkout, that:

  • for a child, you are the child’s parent or legal guardian;
  • for an adult, you are that person, or you have that person’s permission to make a film of them;
  • for a pet, it is your pet, or you have the owner’s permission.

We keep a record of that confirmation. You also confirm that you have the right to use the photo and that it shows no nudity. We may refuse or cancel an order, without charge, if a photo or a request is unlawful, unsafe, or shows a person you have no right to submit. Our providers’ safety filters can also refuse a photo. If that happens you are not charged.

5. How an order works

  1. Checkout. We place a hold on your card for the price of the film. This is not a charge.
  2. The cast reveal. We draw the character and show it to you. You can approve it, ask for one free redraw with a note, or stop the order. If you do not answer within seven days, we close the order and release the hold.
  3. Payment. Your card is charged when you approve the character.
  4. The script. We write the script and show it to you. You can approve it or ask for changes, up to two times, free of charge. If you do not answer within seven days, we treat the script as approved so that your film is not left unfinished.
  5. Filming. Filming starts when the script is approved. From this moment the order can no longer be cancelled.
  6. Delivery. We email you when the film is ready. You watch and download it from your account. Your order page shows the expected time.

6. Prices and payment

Prices are shown in US dollars before you order. Where the law requires us to collect sales tax or VAT, it is added at checkout and shown before you confirm. Payments are handled by our payment provider. We never see or store your full card number.

7. Cancelling and refunds

You can cancel from your order page at any time before filming starts and pay nothing: a hold is released, and a charge already taken is refunded in full. After filming starts the film is made specially for you and cannot be refunded for a change of mind. If we cannot make your film, you are refunded in full without having to ask. The details are on the Refunds page, which is part of these terms.

If you live in the EU or the UK. You normally have 14 days to withdraw from an online purchase. At checkout you ask us to start making your film once you approve the character, and you acknowledge that you lose the right to withdraw when filming starts, because the film is personalised digital content made to your order. Until that moment you can cancel freely as described above.

8. If something in the film is wrong

Every film includes two free fixes. If a scene has a mistake, write to us within 30 days of delivery, tell us where it is and what is wrong, and we will remake that part. If the film as delivered does not match what you approved and we cannot put it right, we refund you. This section does not limit the rights the law gives you when digital content is faulty.

9. What you may do with your film

Once you have paid, the film and the poster are yours to keep, download, and share with family and friends, including on your own social media accounts. This is a personal licence. You may not sell the film, use it in advertising, or remove the credits. If you would like to use a film commercially, ask us first.

10. What stays ours, and what stays yours

The stories, the visual styles, the music, the fairy, the name and the software belong to us or to our licensors. Your photo stays yours. You allow us to use it only to draw the character and make your film, as described in the Privacy page. We do not publish your film, show it to other customers, or use it to promote FairyTakes unless you separately agree to that.

11. Keeping your film

Your films stay in your account while the account is active. We recommend downloading a copy. If an account has not been used for twelve months we will write to you before deleting its films.

12. What you must not do

  • Upload a photo of a person without the right or permission described in section 4.
  • Ask for content that is sexual, hateful, violent or meant to harass someone.
  • Try to get around the safety checks, or use the service to deceive anyone.
  • Copy, scrape or resell the service or its stories.

We may suspend an account that does any of these, and we report illegal content as the law requires.

13. Our responsibility to you

We will make your film with reasonable care and skill. We are responsible for loss you suffer that is a foreseeable result of our breaking these terms, up to the price you paid for the order concerned. We are not responsible for loss that could not be foreseen, or for events outside our reasonable control, such as an outage at a provider. Nothing in these terms limits liability that the law does not allow us to limit, or takes away the rights you have as a consumer in the country where you live.

14. Changes to these terms

We may update these terms. The version that applies to an order is the one shown here on the day you placed it, and we keep a record of the version you accepted.

15. Law and disputes

Please write to us first. Most problems are solved in one message. These terms are governed by the law of the country where the seller is established, and you also keep the protection of the mandatory consumer laws of the country where you live. You may bring a claim in the courts of your own country.
